Acccording to a Civil Justice Survey of State Courts conducted by the U.S. Department of Justice entitled: Tort Bench and Jury Trials in State Courts, 2005: Filing a notice with the trial court to take an appeal to the state's intermediate appellate court or court of last resort represents another option for litigants seeking to overturn or modify a verdict or judgment that they believe does not comply with state law. Notices to file an appeal were filed with the trial court by one or both parties in 13% of tort trials disposed in the national sample.

Acccording to a Civil Justice Survey of State Courts conducted by the U.S. Department of Justice entitled: Tort Bench and Jury Trials in State Courts, 2005: The appeal rate depended on the trial outcome. Plaintiffs filed appeals in 5% of tort trials in which they prevailed and 13% of tort trials in which they lost. Defendants filed notice of appeal in 8% of tort trials with a plaintiff winner; however, they rarely filed appeals in tort trials where the plaintiff did not receive a favorable verdict or judgment.
